S.E.A. Olympus Marketing Inc. treats all its Users’ personal information (the “Personal Information”) as confidential on a secure server and will comply with all applicable privacy and data protection legislation and/or regulations. S.E.A. Olympus Marketing Inc. will only disclose the Personal Information in the circumstances set forth below. Upon registration on the S.E.A. Olympus Marketing Inc. Website, or upon making a purchase, each User will be asked to input, and S.E.A. Olympus Marketing Inc. will collect, personal details such as the User’s name, e-mail address, billing address, telephone number. S.E.A. Olympus Marketing Inc. and our third party providers may collect, information about where Users are on the internet (e.g. the URL Users came from, IP address, domain types such as .com), Users’ browser type, country and telephone area code where Users’ computer is located, the pages of S.E.A. Olympus Marketing Inc. website that were viewed during Users’ visit, any advertisements Users may have clicked on, and any search terms that Users entered on the S.E.A. Olympus Marketing Inc. Website. S.E.A. Olympus Marketing Inc. confirms that any personal details which Users provide to S.E.A. Olympus Marketing Inc. (or which are publicly available) and any User information, from which S.E.A. Olympus Marketing Inc. can identify Users, is held in accordance with all applicable privacy and data protection legislation and/or regulations.

S.E.A. Olympus Marketing Inc. will use Users’ Personal Information only for the following purposes: (i) maintaining Users’ registration, (ii) for statistical purposes to improve the S.E.A. Olympus Marketing Inc. Website and its services to Users, (iii) to serve website content to Users, (iv) to administer the S.E.A. Olympus Marketing Inc. Website and (v) to notify Users of products or special offers.

S.E.A. Olympus Marketing Inc. will not release Users’ Personal Information to any company outside. If a User wishes to unsubscribe from receiving promotional emails or direct mail from S.E.A. Olympus Marketing Inc., such User should email info@olympus.com.ph and insert “Unsubscribe” as the subject line and include the email address that the User wishes to be unsubscribed from (if it is not the email address that the User sent the email from), User’s full name and address.

Eligibility to Purchase Items / Disqualification

By registering on the S.E.A. Olympus Marketing Inc. Website to purchase Items on a personal and non-professional basis in the participating stores, the Users represent and warrant that (i) the personal information provided upon registration on the S.E.A. Olympus Marketing Inc. Website is true, accurate and current in all respects, (ii) they are natural persons, legally capable of entering into binding contracts and not impersonating any other person or entity, or using a false name, (iii) they have the capacity to pay for the ordered items via the payment options provided and (iv) they are at least 18 years old.

Making a Purchase

Users will be guided through the process of placing an order by a series of instructions on the S.E.A. Olympus Marketing Inc. Website. Users may place their order for Items on the S.E.A. Olympus Marketing Inc. Website by clicking on the “Confirm Order” button at the end of the online order process.

Once an order has been placed, S.E.A. Olympus Marketing Inc. will send the User an email acknowledging the exact details of the order, providing the User with a payment reference and the value of the User’s order that will be debited from the User’s debit or credit card or account (the “Order Acknowledgement”). Such Order Acknowledgement does not constitute an order confirmation or order acceptance from S.E.A. Olympus Marketing Inc.. The User’s debit or credit card shall be charged in Philippine Peso (PHP) and all applicable taxes and fees as well as shipping fees, shall be added.

Unless S.E.A. Olympus Marketing Inc. notifies the User that S.E.A. Olympus Marketing Inc. does not accept the User’s order or the User has cancelled his order in accordance with the return policy set forth, S.E.A. Olympus Marketing Inc.’ acceptance of the User’s order and the completion of the contract between the User and S.E.A. Olympus Marketing Inc. will occur when the User receives an email from S.E.A. Olympus Marketing Inc. notifying the User that the Items ordered have been dispatched (the “Shipping Confirmation”). S.E.A. Olympus Marketing Inc.’s acceptance of an order will be deemed complete at the time and date such Confirmation Email is sent to the User, regardless of the User’s actual time and date of receipt of such Confirmation Email. Any information regarding an order can be requested by emailing S.E.A. Olympus Marketing Inc.’ Customer Service at shop@maison-berger.ph. Emails are generally answered within 48 hours.

S.E.A. Olympus Marketing Inc. reserves its right not to accept an order if (i) an Item is out of stock, (ii) S.E.A. Olympus Marketing Inc. is unable to obtain authorization to validate the User’s payment method or (iii) S.E.A. Olympus Marketing Inc. identifies an Item or pricing error. Although S.E.A. Olympus Marketing Inc. endeavors to keep the S.E.A. Olympus Marketing Inc. Website as up to date as reasonably possible, S.E.A. Olympus Marketing Inc. cannot guarantee that any particular Item will always be available. If S.E.A. Olympus Marketing Inc. cannot supply any Item, S.E.A. Olympus Marketing Inc. will automatically refund the payment of the User’s account for the purchase.
